Object and Organisation

These Terms and Conditions set out the terms and conditions governing the provision of services by PLANKTON - ATLANTIC PHOTO EVENTS (registered trademark of Exclusiva - Organização Comunicação e Serviços Unipessoal, Lda), a private limited company with its registered office at Rua Dr. António Martins nº 33 - 4º andar, 1070-092 Lisboa, with capital share of € 5,000.00, registered at the Lisbon Commercial Registry Office (Conservatória do Registo comercial de Lisboa) under the single registration and legal fiscal colective person number (NIF) 502832878.

The organisation of photographic events is the responsibility of PLANKTON - ATLANTIC PHOTO EVENTS, referred to in these Terms and Conditions as such.

These Terms and Conditions of Participation are complemented by the photographic events programes, in which the client subscribes and constitutes the particular conditions of participation in the events.

By contracting PLANKTON - ATLANTIC PHOTO EVENTS, the client recognises and accepts all the terms and conditions established.

Liability

PLANKTON - ATLANTIC PHOTO EVENTS liability is guaranteed by civil liability insurance with Allianz insurance company.

Registration and Payment

The Client's registration will only be valid after full payment or 50 per cent of the cost of the selected photographic event has been made and the elements listed on the PLANKTON - ATLANTIC PHOTO EVENTS website have been completed. The client undertakes to pay the remaining balance of the cost of the event, including any additional services requested, no later than 15 days before the start of the event. If registration takes place 15 days or less before the start of the photographic event, the full price of the event must be paid at the time of registration, subject to confirmation of bookings for all services. PLANKTON - ATLANTIC PHOTO EVENTS (Exclusiva - Organização Comunicação e Serviços Unipessoal, Lda) reserves the right to cancel any registration for which payment has not been made under the above conditions.

By registering, the client agrees that he/she is aware of and accepts these Terms and Conditions of Participation, as well as the programmes of the photographic events in which the client registers, which constitute the particular conditions of participation in the events.

  • That he/she is in good health for the photographic events he/she is asigning for, and accepts the nature of the events and the journeys involved, in particular the risks arising from the impossibility of immediate access to medical assistance.
  • That he/she is aware of the physical, cultural and psychological demands that the photographic events and related journeys may involve and which may lead to unpredicted situations.

Minimum age

The minimum age for participation in PLANKTON - ATLANTIC PHOTO EVENTS (Exclusiva - Organização Comunicação e Serviços Unipessoal, Lda) is 18.

Accommodation

PLANKTON - ATLANTIC PHOTO EVENTS (Exclusiva - Organização Comunicação e Serviços Unipessoal, Lda) provides single rooms for its photographic events. In some cases, when mentioned in the event programme, the accommodation may be in a double room or for more people, dormitories, camping tents, beds in cabins or others.

PLANKTON - ATLANTIC PHOTO EVENTS (Exclusiva - Organização Comunicação e Serviços Unipessoal, Lda) may group clients who book individually for the same trip into pairs (or another number if the accommodation is not for two people), by gender. In some events, due to the characteristics of each accommodation, separation by gender may not be possible.

Documentation

The client is responsible for all personal documentation (identity card, passport, military documentation, visas, vaccination certificates and any other documentation required) necessary for the photographic events. PLANKTON - ATLANTIC PHOTO EVENTS declines any responsibility for refusing to grant visas or not allowing the client to enter a foreign country; in these cases, the conditions set out in the "Cancellations" clause apply, and the Client is also responsible for any and all costs arising from this situation.

Use of customer information

The client expressly consents to all information, including personal data, provided in relation to their photographic event being passed on to government authorities for border control and security purposes when travelling by air or otherwise.

The client gives express consent for all information, including personal data, provided in relation to their photographic event and travel to be passed on to local partners of PLANKTON - ATLANTIC PHOTO EVENTS (Exclusiva - Organização Comunicação e Serviços Unipessoal, Lda) in order to be able to carry out the photographic event programme, including tastes, food preferences, particular health information or others.

PLANKTON - ATLANTIC PHOTO EVENTS (Exclusiva - Organização Comunicação e Serviços Unipessoal, Lda) will make the necessary contacts with the client in order to guarantee the smooth running of the service.

Meeting point and start of the photographic events

The meeting point of the client with PLANKTON - ATLANTIC PHOTO EVENTS Manager or PLANKTON - ATLANTIC PHOTO EVENTS trip leader and the other participants for each photographic event will be communicated to the client by email. The exact location will be communicated to the client well in advance of the event.

It is the client's responsibility to purchase air travel or other means of transport to take them to the place where the PLANKTON - ATLANTIC PHOTO EVENTS photographic event programme begins. It is also the Client's responsibility to be at the meeting point at the time indicated for the start of the journey.

Language spoken while travelling

PLANKTON - ATLANTIC PHOTO EVENTS (Exclusiva - Organização Comunicação e Serviços Unipessoal, Lda) photographic events will be in English and Portuguese. There will be groups of Portuguese or non-Portuguese clients, where it will be speak English or Portuguese.

Date changes

Clients registered for a photographic event in São Tomé and Príncipe may not change their registration to another trip or to the same trip departing on a different date without the express consent of PLANKTON - ATLANTIC PHOTO EVENTS (Exclusiva - Organização Comunicação e Serviços Unipessoal, Lda). If it is possible to make such a change, it may be subject to the expenses and charges provided for under "Cancellations".

Assignment of Registration

The Client may assign their booking, substituting themselves for another person who fulfils all the conditions required for the event, provided that they inform PLANKTON - ATLANTIC PHOTO EVENTS at least 60 days before the departure date and that the different suppliers of the photographic travel services accept the substitution. If the client wishes to give up their booking to a person of a different sex, they may be liable to pay the individual accommodation supplement for the photographic event or a cost of the same nature if this is not provided for the photographic event they have booked, in the event that it is not possible to group the new participant with another person of the same sex.

The transfer of the booking makes the transferor and transferee jointly and severally liable for payment of the price of the journey and any additional charges incurred.

Changes

Whenever there are external reasons justifying it, PLANKTON - ATLANTIC PHOTO EVENTS may change the order of events and routes, modify departure times or replace any of the accommodation or transport provided with others of a similar category and location.

Minimum number of participants and cancellation of the programme by PLANKTON - ATLANTIC PHOTO EVENTS

The photographic event programme will set the minimum number of participants on a case-by-case basis. If the minimum number of participants is not reached, PLANKTON - ATLANTIC PHOTO EVENTS may cancel the photographic event and will inform the client in writing of the cancellation up to 15 days before the departure date, reimbursing the Client for all sums paid, with PLANKTON - ATLANTIC PHOTO EVENTS being released from any liability for the cancellation.

Cancellations

If the Client withdraws from the event up to 60 days before the start date of the photographic events programme, 30% of the value of the event will be charged, which was given by the Client to PLANKTON - ATLANTIC PHOTO EVENTS as a non-refundable deposit. If they withdraw 60 days or less before the start date of the programme, they will lose the full amount of the photo event programme. The Client will also lose the value of any additional services that they have requested and which have non-recoverable charges.

Refunds

Once the photographic event has begun, no refund is due for services not used by the Client. Failure to provide the services provided for the photographic event programme for reasons not attributable to PLANKTON - ATLANTIC PHOTO EVENTS, and if it is not possible to replace them with equivalent services, entitles the Client to a refund of the difference between the price of the services provided and those actually provided.

Price changes

The prices in the photographic events programmes are based on the costs of the services and exchange rates on the date of the programme, and may therefore be subject to changes resulting from variations in the cost of transport or fuel, duties, taxes, fees and exchange rate fluctuations.

Whenever there is a change in the price of the photographic event, the Client will be informed immediately and invited to accept the increase or cancel their booking within the set time limit, under the same terms and conditions as those set out under the heading 'Impossibility of fulfilment'.

VAT

All prices indicated on PLANKTON - ATLANTIC PHOTO EVENTS website already reflect Value Added Tax at the current rate.

Insurance

The Client undertakes to acquire travel insurance, which may or may not be purchased through PLANKTON - ATLANTIC PHOTO EVENTS (Exclusiva - Organização Comunicação e Serviços Unipessoal, Lda). The insurance must be adjusted to the duration of your photographic event, destination and type of activities. By not taking out travel insurance or by purchasing inadequate travel insurance, the Client automatically exempts PLANKTON - ATLANTIC PHOTO EVENTS (Exclusiva - Organização Comunicação e Serviços Unipessoal, Lda) and all its partners services providers from any and all liability for the risks and consequent costs incurred by the Client as a result of not having taken out the recommended protection.

Complaints

Complaints can only be considered if they are submitted in writing no later than 20 days after the end of the service. They can only be accepted if they have been reported to the service providers (hotels, guides, local agents, etc.) during the course of the photographic event, trip or stay, requiring the respective documents proving the occurrence.

Any dispute arising from this service contract shall be settled by the Judicial Court of the District of Lisbon, expressly waiving any other jurisdiction, and for all matters not governed by these Terms and Conditions of Participation, Portuguese law shall apply.

For any legal dispute, the parts agree to be settled at Centro de Arbitragem e RAL (Resolução Alternativa de Litígios de Consumo) / Consumer disputes at the following address: Rua dos Douradores 112, 1100-207 Lisboa, at the following working hours: 10 AM – 6 PM⋅ Monday to Friday. The contact from the Centro de Arbitragem is 21 880 7030.

Luggage

PLANKTON - ATLANTIC PHOTO EVENTS (Exclusiva - Organização Comunicação e Serviços Unipessoal, Lda) is not responsible, under any circumstances, for the luggage and other belongings that the Client takes with them, regardless of the location or means of transport used. The customer is recommended to take out luggage insurance and to be present at the loading and unloading of luggage. In the event of theft, deterioration or destruction of luggage, the customer must immediately complain in writing to the service provider and/or organisation in whose care the luggage was deposited, keeping a copy of the complaint. PLANKTON - ATLANTIC PHOTO EVENTS (Exclusiva - Organização Comunicação e Serviços Unipessoal, Lda) shall only be liable upon presentation of proof of the claim provided for in the previous paragraph.

Note

These Terms and Conditions are supplemented by the programme of the photographic events in which the customer is enrolled, which constitutes the particular conditions of participation in the journey. They may also be supplemented by any other specific conditions sent to the customer at the time of enrolment or any other conditions duly agreed by the parties.
